MEMCORP INC FILES MOTION TO STAY PROCEEDINGS IN DVD PATENT INFRINGEMENT CASE FILED BY TOSHIBA
San Diego, CA., May 11, 2007 -- Memcorp Inc. today announced it has filed a motion to stay proceedings in the highly publicized DVD patent infringement lawsuit filed by Toshiba Corporation (NYSE: TOSBF.PK).
Handal & Associates acting on behalf of defendant Memcorp Inc. has filed the motion with the Northern District Court in San Francisco on the ground that a similar action is currently pending with the United States International Trade Commission (ITC), making this lawsuit unnecessarily duplicative under 28 U.S.C. § 1659.
Toshiba Corporation filed a lawsuit in April of 2007, accusing various companies of violating its DVD patents. In May of 2007, the ITC initiated its own investigation into the sale of DVD related products which allegedly infringe the patents of Toshiba.
“Toshiba’s true motives are still to be determined inasmuch the instant action is inconsistent with its position as the managing member of the DVD 6C patent pool” said Anton Handal, counsel for Memcorp.
The motion to stay Toshiba’s lawsuit is set to be heard on June 15, 2007 in Courtroom 8 of the Northern District Federal Court in front of the Honorable Charles Breyer.
